    Default £1 for Deed of Assignment returned uncashed - confused

    Hi
    I sent a Deed of Assignment etc. request with a £1 postal order to RBSicon debt collecting agents via recorded delivery last Friday.

    Received a recorded letter from them today (Thursday) returning the postal order and stating that they have closed the matter and won't be taking further action against me. So I assume I don't have to pay them any more money.

    So can I reclaim the money I paid to them via small claims court?

    Are the 14 days still ticking? They haven't sent the paperwork I requested. What should I do now please, really confused.

    Whatever do they mean?

    Phoned the branch and they said they don't deal with Data Protection Act requests
    That's pathetic, they should at least pass your letter on to the relevant department, without being prodded

    Are the 40 day's still ticking?

    That is just cheeky! Call them again and tell them you are putting a formal complaint into the Information Commissioner and the Banking Codeicon standards group as they have just broken about 3 agreements of the banking code alone not to mention the data protection act. ALL their staff are supposed to be trained in how to deal with enquiries/letters about the data protection act and can be fined if they essentially block you from accessing your info. Ask them for the address of their compliance dept and that you are complaining officially - they back down quick enough when you know your rightsicon and what their responsobilities are.

    I would actually go ahead and put these complaints in as they will be treating others like this thinking they can get away with it. Best of luck!
