Reclaiming PPI on very very old LTSB loan!
Hi everyone
I know I must seem like a total glutton for punishment (apart from being a complete mug for having been talked into having PPI so many times) and this one is probably hopelessly dead in the water before I start, but just wanted to see what your thoughts are on this.........
Twenty years ago when I was recently married with a new baby, I took out a loan with Lloyds TSB. I had a very low income from part-time self-employment in a small business venture with my Father. At that time Mr L and I lived in a property owned by my parents, had no credit cards and consequently were considered a high risk. I was told I had to have the PPI or wouldn't get the loan - usual story
I had completely forgotten about this loan until I received the contents of my SAR from LTSB. They said they no longer had details of loan account number **** which was taken out on ****1989 and repaid on ****1996.
I am yet to have a proper search through our old paperwork for anything connected with this loan, but have a feeling any proof I might have had has long been lost or destroyed during one of our house moves.
I'm just wondering what my chances are of being able to reclaim this PPI, bearing in mind Lloyds have already said they no longer have the paperwork and all I have are the account number and dates?
Unfortunately its one of the few loans we appear not to have repaid early - meaning I paid many PPI premiums
I know that it has been said a financial institution can reconstruct an agreement with just the bare bones and I feel that if they have the account number and dates on file they may have more, but this is Lloyds who are notoriously unwilling to comply!
Any thoughts please anyone?

If you can get the evidence then you should claim. If you were sold PPI when you were self-employed then it seems to be a foregone conclision

Well I've had a good old dig through our ancient paperwork and have been unable to find either the original agreement or any statements relating to my account at the time this loan was in force, so I might just have to give up on this one.
A shame as there would have been 7 years worth of PPI and interest back to 1989 to reclaim

Bang in a claim for mis-selling give them the account number and the dates and let them work out what they owe you if they do not respond then bang in another complaint to the fos. This may not provide a refund but it gives the bank food for thought and another fee of £500 payable to the FOS ( I must check up to see if the fee is still the same the FOS would be daft not to increase the fee looking at all the work they are getting) :grin:

HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

Just an update on this thread -
I sent my first letter relating to the mis-sold PPI on this old, settled loan account last week and today I received an acknowledgment that my complaint had been received and has been allocated to a case handler. The letter seems to be an improved format on previous ltsb PPI complaint responses.
I wonder how long it will be before they say they are unable to investigate because the paperwork no longer exists?
Will let you know how I get on!

I'm going to get my eye on this one Landy! My OH had a Natwest Loan back in 1997/98 he lost his job and when he tried to claim on the PPI they refused. Ended in the loan being defaulted and having to pay off the remainder of the loan which I think took until about 2001. I don't think I have an account number but may be able to trace it another way.

I presume you've exhausted all the obvious avenues - SAR, searching in the attic for old paperwork etc? It's amazing how much stuff you do manage to find once you start looking. Unfortunately we used to keep all our old docs, then prior to moving a couple of years ago when Mr L had depression problems, he shredded masses of letters, statements etc so some potentially important things such as the statements relating to this loan account were lost.
Don't give up though and I'll follow your progress with interest too!

Sorry to hear about that Birchave0 - as long as you and your family were not harmed? The loss of some paperwork pales into insignificance of course in comparison to the well-being of your loved ones.
Hopefully you'll find what you need at your sister's stables and you'll have a nice trip out as well
With regards to a SAR to Nat West - I s'pose there's a chance that they may still have something on file. If you paid the loan off in 2001 or thereabouts, it is possible. Our ltsb SARs contained statements back to 1999 and loan statements from a similar date, so it could be worth a try.

Well, as expected I today received the following response from ltsb (complete with bad grammar highlighted in red!) -
'We are currently investigating a complaint regarding the miss-selling of payment protection insurance for loan **********.
Due to the time that has lapsed since you've took the policy we are unable to locate any documentation relating to the sale.
I am therefore closing this case down, however we can re-open the complaint if you can provide us with any relevant documentation with regards to the sale of this loan.'
They do go on to say that if I'm not happy I can still pass my complaint to the fos, which I shall do of course
Whether the FOS will be able to investigate considering the lack of information I can provide is another matter.
Will let you know how I get on.

Lack of information on a SAR do not forget the Information Commissioners Office
You should submit a serious formal complaint about the LTSB failure to supply the data request.
I sent one myself on tuesday about Barclays. No information supplied under the SAR in line with the Data Protection Act 1998 results in a complaint to the ICO for non compliance.
We must make these banks sit up and take notice of the legal statutes of the United Kingdom.

Well, as today seems to be my day for resurrecting old threads and finally retrieving claims left sitting on the back-burner, I have decided to act on the suggestion of Di0430 (thanks Di ) and send off a CCA request for this agreement as you may remember that I only have the account number.
From that comment you will realise I haven't yet followed up the fos route and although I am just out of time - it being almost exactly six months since ltsb issued their final response, I believe I saw somewhere that the FOS were allowing a little extra time on PPI complaints being filed...........please correct me if I'm wrong though!
Anyway, it's only £1, so I might as well give it a try and see what, if anything they come up with.
Will report back as and when!
