    • Massive issues from Scottish Power I wonder if someone could advise next steps. Tennant moved out I changed the electric into my name I was out the country at the time so I hadn't been to the flat. During sign up process they tried to hijack my gas supply as well which I made it clear I didn't want duel fuel from them but they still went ahead with it. Phoned them up again. a few days later telling them to make sure they stopped it but they said too late ? had to get my current supplier to cancel it. Paid £50 online to ensure there was money covering standing charges etc eventually got to the flat no power. Phoned Scottish Power 40 minutes to get through they state I have a pay as you go meter and that they had set me up on a credit account so they need to send an engineer out which they will pass my details onto. Phone called from engineer asking questions , found out the float is vacant so not an emergency so I have to speak to Scottish Power again. Spoke with the original person from Scottish Power who admitted a mistake (I had told her it was vacant) and now states that it will take 4 weeks to get an appointment but if I want to raise a complaint they will contact me in 48 hours and it will be looked at quicker. Raised a complaint , complaints emailed me within 24 hours to say it will take 7 days till he speaks with me. All I want is power in the property would I be better switching over to EON who supply the gas surely they could sort it out quicker? One thing is for sure I will never bother with Scottish Power ever again.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

Ideally we could do with seeing it. If you can post it up minus any personal details that will help.

 

In the meantime, does the agreement have:

 

The APR

A credit limit or a statement saying one will be set

Repayment terms

 

And how old is the agreement (when did you first take it out)

I have seen online agreements that have a tick in a box which makes it enforceable but with yours, they are asking for a signature so I would think this one is an online one but they then send an agreement for you to sign.

 

It's a difficult one this because lots credit card companies are sending out reconstructions of agreements which leave out certain info (and legally too) because they are either too lazy to go find the original or they don't have it.

 

Without a signature, a court would not be able to enforce it

 

I know that this doesn't help much.

 

Have you tried to SAR them? Just in case, here is the link:

A SAR should get back everything they have including your agreement. If it is the same as above then it's a good bet they don't have your signature.

Hi just looking over some of my debt ,

 

 

i had a credit card with paypal which was opened online

 

 

now it got sold to cl finance which i pay a small amount every month ,

 

 

looking at my credit file from equifax

ive noticed it says the account defaulted on 02/2009 ,

 

 

i have just recieved the default notice from cl finance which is dated 14 th december 2009 meaning that it had been defaulted before i got the notice ,

does this make it unenforcable in court ?

hi

ive got a couple of old debts with robinson way ,

one a old credit card

and a old loan ,

 

i sent off cca's years ago and they both had a signed agreement ,

ive been paying £1 a month for the last 4 years or so ,

 

today i got a letter from robinson way saying they are prepaired to accept a lower payment

 

the debt is £3200 they are wanting £700 .

 

I am thinking of sending them a letter offering £200

but was wodering if there is a template to use for making full and final offer .
