Aaah what do I do now? Barclaycard and microfiche.
I'm having nightmares with Barclaycard!!!!
First I wrote requesting copy statements. They requested their £10 fee which I paid up like a good little customer.
Then they sent me statements dating back to May 2004 with a covering letter stating that all statements prioir to that are held on microfiche and so are not covered by the DPA but can be purchased at £3 each.
I replied with the "Abbey Letter" and have now received a letter in reply saying that they do not accept they have to produce them, they believe that the case smith-v-lloyds supports their position and basically telling me to go away.
I,m about to go and read up on DPA non compliance but I'd be interested to know if anybody else has come up against this and what they have done.
Re: Aaah what do I do now? Barclaycard and microfiche.
Ive just had the same microfiche letter back . Looking throuh the threads it seems to be a real problem. I have around £150 I could claim since may 2004. Should I just settle for trying to cliam this or wait for a light at the end of the tunnel?...
Re: Aaah what do I do now? Barclaycard and microfiche.
This seems to be a recurring theme with Barclays, if you havent done so you can send the follow up letter confirming the request for statmenets and remindg them of the time left under the original SAR.
When the 40 days are up you send the prelim letter, followed by the lba, and finally take them to court.
They will provide the data because they now that the case supports the case that unstructured bundles of paper arent a 'relevant filing system' since microfiche isnt the same and is structured they will lose I believe.
This is all JMHO, but if you search throug the barclaycard forum you will see others have been adivsed this by one of the mods, alan, so i think its probalby the way to go.
If ive got it wrong id be pleased for the mods to correct the advice.
