Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
hi there
Im a newbie to this board and just wondered if someone could help me.
I received a Full and final settlement letter from A&L regards PPI in september. Have waited until now to receive the cheque with no avail.
A bit of background about me - i entered into a trust deed and A&L were one of the companies included.
Anyway, I spoke to them today and they have told me that the person who initally calculated the refund I was due inc interest has made a mistake. (not my fault I told them promptly!) My F&F settlement figure was £1600 now they are saying they will only pay back £400ish as that is all I paid. That is correct, BUT, their F&F settlement letter stated they would be paying out £1600.
What should I do?? Im planning to phone fos tomorrow to get some advice.
Over how long a period were the PPI premiums deducted and what was the basis of their misselling.
Don't call anyone until you have received advice from us. fos advice wil tend to be lukewarm

NEVER EVER - act on a private message asking you to visit another website, make contact 'off list' or by telephone
- alert the siteteam IMMEDIATELY by hitting the black warning triangle on any message - Particularly if this results in a request to pay a fee to help you.

Mis-selling = was never told about the PPI, I was (and still am) in full time permanent employment with my local authority
FOS have always been helpful in the past with me.
My point Im trying to make and will make to the FOS is that, they (A&L) sent me a Full and final settlement letter in september and they have now changed their mind. Totally out of order.
You haven't responded about the period over which you paid the PPI premiums.
How was the FF letter expressed? Were you require to repond with an acceptance? Did you accept it in any way?

Sorry, the premiums were paid over 3 years, just before I entered into the TD.
I did respond to A&L regards to the FF letter. The letter states - Our investigation is now complete, having considered the available information we have not been able to establish whether you were provided with sufficient details to allow you to make an informed decision when this policy was taken out. We would like to make you a total offer to you of £1673.54.
This amount included total monthly premuims to april 2004, rebate adjustment, total refund, interest on total refund payable to 30 sept 2009 which totals £1673.54.
a sort of fire-fighting role here. Hate HFC & their past compulsory PPI ethos

so this was a loan?
£1600 odd would be about right if the A/C dates from 2004
how much was your monthly payment [either with or with the PPI if known}

Maybe you could be a bit forthcoming about the useful details.
You say that you responded - but what did you respond?
Did the letter from A&L contain the calculations or just the statement which you have quoted above?
What are the dates that the PPI was entered into and the date that you stopped the premums? Are you saying that you challenged it in 2004?
How do you arrive at your calulations of £1673.54? Is this your onw calculation or is it theirs?
Ine of the most important wuations is how long were they holding your PPI premiums.
Maybe you could give us a careful and bullet pointed chronology

You say that you responded - but what did you respond? - I responded to their letter for FF settlement, I completed their form accepting the amount of £1673 that THEY had offered me. The form was to be completed stating whether or not I was happy with the decision that they had made and where the cheque was to be sent to.
Did the letter from A&L contain the calculations or just the statement which you have quoted above?- Yes, it was their calculations included in their letter
What are the dates that the PPI was entered into and the date that you stopped the premums? Are you saying that you challenged it in 2004? No i didnt challenge it in 2004, I started a claim to reclaim the PPI from them August 2009
How do you arrive at your calulations of £1673.54? Is this your onw calculation or is it theirs? this is their calucations
Ine of the most important wuations is how long were they holding your PPI premiums. - dont understand this question, sorry
Maybe you could give us a careful and bullet pointed chronology
