    Default Question regarding Without Prejudice Letters

    I have to send in a statement of truth, with supporting documents, to the courts regarding my claim against non compliance of SARicon by Barclays. During the course of negotiations, Barclays have sent a couple of without prejudiceicon Letters containing monetary offers, to get me to drop the case. I am only interested in getting the information that I requested, and in my replies, I have not referred to the money aspect, other than to say I just wanted my costs covered.

    My question is, can I give my replies to the without prejudiceicon letters to the court?

    without prejudiceicon

    A legal phrase that allows parties to discuss and negotiate a settlement to a legal claim, without admitting liability. Any documents headed "without prejudiceicon" cannot be used in evidence in any subsequent court case without the permission of both parties.

    Your replies weren't without prejudiceicon, only theirs.

    Make sure you do not post anything which identifies you. Although we can remove certain things from the site unless it's done in a timely manner everything you post will appear in Google cache & we do not have any control over that.

    Providing your own replies are not headed up "without prejudiceicon" then I can't see the problem.

    I'm still waiting for a response to the above request.
    However, a court would not be prepared to receive sight of documents which disclose information contained in other without prejudiceicon documents.

    If you want to disclose WP information then you would have to discuss it with the judge first and convince him that there is a good reason for the disclosure. I'm afraid that you are not able to get around the without prejudiceicon rules simply by being "smart" about it.
