    Default Bad Roads damaging to cars

    On the way to work the other morning i was pulling into the road i normally park but had to move to the side for a passing lorry as i did this i went down a ditch in the road which had damaging effect to underneath my car it broke loose the bracket which holds the engine which is now shaking when i drive.
    Now i know the roads are the councils responsibilty is there anything i can do to claim compensation as this is now going to set me a good few quid?

    not unless you can show negligence, ie the council were informed of the condition and failed to act

    Well i've noticed this pothole for a while and i always try to avoid it, i guess as there is building site with alot of lorrys passing i guess the blame will be passed on with the council not taking responsibilty.

    I think if you report this to the council and they dont act the next time it happens you can claim.

    My friend had an alloy wheel cracked on a road - he wrote and tried to claim £150 for the cost of a new wheel, they said not their fault as no one had brought it to their attention, 2 months later same hole cracked a new wheel (u'd think he'd learn!).

    he wrote and asked for money for damage again - they sent same letter saying they didnt know about it, he responded with a copy of his first letter and invoices for repair work to his car etc and they paid up without court action...needless to say the road in question has been relaid now and is smooth as a babies...


    i know its not much help to you but if you report it and it hapens again then then you may have a leg to stand on.

    I wouldn't give in so easily. Claim anyway, regardless of whether or not it has been reported they will reject your claim but threaten court action and they might pay up.

    If it's a road often patrolled by traffic wardens etc. you could claim negligence if their own council staff haven't reported it especially if it's been like that for a while. There are a few roads in our area that have been bad for years but one now has a wide pothole in it that has sunk so badly my car bottoms out on it. this riad is regularly patrolled by council-employed traffic wardens who I believe are expected to report this sort of thing, and by police vehicles - the police station is just around the corner.

    I can't for the life of me understand why these roads are ignored whilst millions are spent on unnecessary "improvements" to juctions and trafiic lights all over town, unless they are deliberately leaving them to slow traffic down - wouldn't put it past 'em in Blackpool!

    Even if they where not told the council will have to show, to avoid liabilty, that they make regular "walking inspections"

    Take a photo of the pot hole with a measure to show the width & depth because when you complain they may fill it in. Write to the council holding them liable for your damage. They will reply denying liabilty & when they do, respond by asking them for a copy of their "walking inspection" schedule for that road.

    After you get that let us know!

    Its' actually cheaper for them just to pay compensation rather than undertake the work. To get compo you have to be persistent

    Rich Almost forgot pick a datum & take photos which show the road the pavement upto the pot hole from 25/50/75 metres. That will show how visible it is. & this won't matter to you as you HAD to move to one side because of other larger traffic
