I have an account with Egg who supplied me with a true CCA and I have been making regualer monthly payments, never missing one, for the past four years.
They also took me to court in 2005 and I have a CCJ against me for £354 of arrears which was made up of charges.
They have defaulted me on my credit file but it is showing (8) but as I haven't missed a payment in four years this information is not accurate.
You can retrospectively claim full refund of unlawful penalty charges back to October 2003. You received a CCJ so default at the time was proven. If you say "Had unlawful charges not been levied then overlimit breach then DN would not have been triggered", well overturniing DN requires a county court lawsuit not Small Claims Court, separate from penalty charges reclaim.
You are welcome to try, but one person took 18 months and lost weight doing it, another took 30 months. It is easier to get blood out of Count Dracula than a DN withdrawal from Egg.
If you are stuck with a CCJ, why worry about a DN?
