    Default Old Cap1 card

    Hi all

    Was just wondering if anyone knew if we were in a position to claim back charges from a credit card that has now been settled? i think it was settled little less than 2 years ago.

    Any help would be appreciated.

    Yes you can. As long as you can remember your account number, send a Subject access requesticon for your statements and take it from there.

    No problem, I had to get Sheriff Officers to serve my court papers on them, but as soon as they were received, the paid up

    To date, have heard nothing at all regarding this. Not surprising.

    however, they have got til 5th December to produce. If they don't what is my next action as this is an old account i.e paid off.

    eventually received back the SARicon. I have checked and there are plenty of charges and what I find strange is, the card was taken out in 2002, and yet in 2003 suddenly some payment protection charges were being added, all of it in total adds up to over £800, can I ask for the payment protection back to, we obviously didn't take it out to begin with as it would have surely shown up in the 2002 statements?

    Update

    I went out to CAP1 for refund on this old account and they sent me a letter stating

    "the OFT has not challenged the right of banks to charge default sums, just the level of them"

    They are basically saying that they reduced them to £12 in 2006 so will only refund the difference for the ones previous and have offered a pathetic £72 as opposed to the 800+interesticon, came to over £1000 we were asking for.

    What should our next move be? can anyone advise?

    Yes, they told me that also, but paid up, once they received my court papers.
    I'd continue with the claim.

    I'm not too sure about the PPIicon issue, I'll ask another Mod if he can help.

    They are still playing silly games with me on my account tho! and i am still being chased for payment, however, i am standing firm and telling their solicitors to bog off as my account is in disputeicon.

    Quite funny really, how can they go from an offer of 72 quid to over 300? They "kindly" looked at the claim again and have said they are prepared to offer this 3oo and odd quid! How very nice of them compared to the approx £1150 I was asking! That'll be a NO then lol

    What is the next letter I need to send, will respond and tell them
    I will accept as part payment but do I go on to say that I will still be seeking the full amount? Is it letter before actionicon? I'm lost!
