Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Hi all and thanks so much for all the advice. Head is just about above water and trying to keep it there.
I've been dealing with my creditors but have a huge problem with Egg. They refuse to reply to any of my letters other than sending threats and I have now tried their secure message system to get hold of someone to try and agree some kind of solution.
Trouble is they refuse to talk and have said:
Dear Tom
As my previous colleague stated, unfortunately the collections team do need to have a telephone conversation with you regarding this matter. Please contact them on 0845 7000 775.
They're open Monday to Friday 8am until 5.30pm.
If you've already spoken to our Collections Team, then please disregard this message.
Thanks for your message.

Dear Sir/Madam,
I find it very hard to believe that they do not have the ability to use this secure message system and reiterate that I wish to deal with this matter as soon as possible but will only do so via email or post.
Please therefore, ask the collections team to write to me as soon as possible.
Regards,
xxx

Dear Egg,
I have now sent a number of letters to you indicating both my financial difficulties and my attempts at resolving the problems. Following advice from payplan I asked you to accept my repayment schedule of £36.06 on the loan and £96.32 on the credit card until I am in a position to pay more.
Unfortunately, you have not at any point responded with either acceptance or refusal of this, just added interest to the balances.
I do not get regular internet access, and so as requested, please please write back to me.
Regards,
xxx
Any ideas as to what I can write to get them talking?
Hi Harptree,
I am relative newcomer myself but what I can tell you is that you will be advised off the senior 'caggers' not to resolve any problems with a creditor over the phone.
Firstly to acheive what you want you need to try and strengthen your position. You didn't say when you took out the loan or credit card agreement as this will relevance when you are advised later how to proceed.
If it was pre-2006 then chances are that the agreements maybe unenforceable. This means that when you have folowed certain procedures they will not be in a position to demand 1p never mind what you are currently offering them. That isn't to say that you should or would but the point being when you have the upperhand suddenly they will start to listen and if they don't you have the option not to pay them at all(providing the agreements are not enforceable)
Let me know and I will post you the letters you need to send out.

Thanks for the replys. I have CCA'd them, and they haven't responded to the request whatsoever. I am though eager to get a dialogue going.
What I am asking is whether or not you can say anything to enforce your position that you ARE entitled to discuss via email or letter. They appear to refuse to discuss on anything but phone . . . .?
Make sure you do not post anything which identifies you. Although we can remove certain things from the site unless it's done in a timely manner everything you post will appear in Google cache & we do not have any control over that.

Did you send the CCA request letter recorded and when did you send it?

Hi,
Well the accounts in dispute so legally until they provide you with documnetation to the contrary you are not legally obliged to pay them anything. I would stop paying them they will soon write to you and you can go from their.
They probably think because you have continued to pay them that you are not aware of your consumer rights!!
Hope this helps
