    Default Dispute with Barclay Card

    Hi All

    I have been reading through the threads and found some very interesting information here. Yet I find myself a little confused. The CCA template letter refers to s77 of the consumer credit act 1974 this seem to cover fixed sum credit agreements. Where as s78 pertains to running account agreements.

    On reading through s77 and s78 copied below


    78-0)
    The creditor under a regulated agreement for running-account credit, within the prescribed period after receiving a request in writing to that effect from the debtor and payment of a fee of 15 new pence, shall give the debtor a copythe executed agreement (if any) and of any other document credit referred to in it, together with a statement signed by or on agreement. behalf of the creditor showing, according to the information to which it is practicable for him to refer,-




    The type in red would seem to suggest to me that they don't have to have one or has this been ammended in a later act

    Hi All

    I had a call from Barclaycard this morning 29/10/2009 re my CCA. They are sending copies of the terms and conditionsicon and other documents yes not the signed agreement (credit agreement / application form). They are saying I will have to do another CCA to request this. Has anyone else had this problem.

    Hi BMWM,

    Read some of the other threads here in BC and you'll see many cases having the same problem.

    You do not have to do another CCA request, if the one you sent was out template letter enclosing the £1 fee.

    Are there any penalty charges or PPIicon on the a/c which you can reclaim.
