Before you start this, what is th ebasis of your allegation of missellingicon and what is the evidence which you have to support it?

I was told at the car showroom that I would need to take it as it would help my credit application. as for the other 2 insurances, having been there for 8hours I had lost my powers of full concentraton & said yes as the guy suggested I took them as it was a HP agreement. The car place has of course been out of business for about 4 years now (further info companies house check Car Credit UK).

They never did a statement of means to see if the insurance was relavant although they did send a blank copy of one in the SARicon

Having been alerted by the press that PPIicon could be a problem, I looked through the T & C's to find that the only reason I would have taken it out for (loss of employment) I would not have agreed to it (or I would of cancelled it soon after getting the car.

I dont really have a problem with the MBI as I did have a claim on it (not £650 but a fairly large sum £300 I think)

Shortfall insurance I have no idea why I would want it & it wasnt explained

I think they are valid reasons (the guy also told me that I could change my insurance from fully comp to 3rd party only as I wouldnt really need it)

I always knew there was something fishy about welcome as I never got a service history with the car

So Bankfodder what do you think ?

just checked my insurance details & find this quite interesting

Credit Protection Insurance - Inception date 17.5.2004 - Term 48 months
Shortfall Extra - Inception date 17.5.2004 - Term 48 months
    Mechanical Breakdownicon Insurance - 17.5.2004 - Term 36 months

Please note all of these policies have now expired but the Credit Protection Insurance looks as though it was cancelled prior to expiry.

So the shortfall & mechanical breakdown were not stopped

    what do you think people

It looks as if you have got a good basis for your claim. However, I don't think that it is the kind of cut and dried case which you could put in front of a court and be completely certain of winning. You wuld have to be confident about arguing your case to a judge and responding to unexpected points put forward by the other side.
Of course you could end them an lbaicon and hope that they will be bluffed nto putting their hands up. However, I never think that it is worth bluffing and I doubt whether they would fall for it. They don't care enough.

I think that this is a good case for the fosicon with a very high chance of winning.

Set out your entire case, carefully and succinctly - in chronological order and each point supported by evidence.
Write initally to Welcome and say that you want you money back plus interesticon and warn them that if they don't accept then you want it to go to the FOS.
If they don't comply within 8 weeks then put the complaint before the FOS.

I think that this is probably your best route in this case
