some months ago, my daughter withdrew herself from an IVA which she had entered into with her now ex partner. her debts were so little compared to her ex, that it seemed the sensible thing to do.
she has since written to barclaycard offering a Full and final settlement.
after three months and barclaycard didnt respond at all, she wrote again, and they still havent replied. this has been going on for about 4-5 months now.
now, we just dont know what else to do.
barclaycard must be aware she is no longer in an IVA, because another creditor had been informed of her change of IVA status by the IVA practictioner, and has written to her. she also wrote to Capital One at the same time as barclaycard and they too, have not responded.
i thought it may be a nice idea to write to them again, and say that if they dont respond within 28 days, she will assume that they have written off the debt!!
BC are not very good at responding to letters. Especially if it is an unusual situation which requires a non-template letter response.
Has a formal CCA request been sent to BC, asking for a copy of the agreement.
Are there any penalty charges or mis-sold PPI on the a/c which should be reclaimed, with interest. A SAR should be sent if you don't have all the a/c statements.
I don't think the "respond in 28 days or I assume the debt is written off" is a good idea as it has no basis in law.
BC do not normally agree to F&F settlements while they still own the a/c. Mercers may negotiate on this basis but this would normally happen after the debt has been sold on to a third party DCA.

i do think that i might give it a go though. purely on the basis that BC have taken over two years to not reply to my son and 5 months or so to not reply to my daughter. it must be a family thing!!!!!
you never know, it may shock them into doing something. xxxxx
