Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Just pondering my potential journey into the store card reclaim of charges and want some advise on what to expect, pit falls etc.
Quick summary of my journey so far with CAG for those who have not seen me around. I joined in February after tiring of MBNA and their small print. Was just about coping with slightly above minimum payment on several credit cards and thought I needed to get to grips with my finances. So far I have CCA'd Egg, MBNA, Capital One, Lloyds. Currently Cap One and Egg are on a back burner, and am dealing with the two worst; MBNA and LLoyds. LLoyds, despite being in dispute due to lack of any real CCA have defaulted me.
The first of the fall out letters started last week from Santander, reviewing my credit limit with them. Currently I do have store cards, but nothing seriously owing on them.
They have now reviewed me and reduced my credit limits as follow
Debenhams from £8000 to £200
Dorothy Perkins £500 to £200.
Now its not that I need to use them but have read that we are entitled to claim back unfair charges, so I need to know the procedure. Do I CCA them individually, or do I send out a SAR to get everying they have on me.
Over the years I have encountered one or two late fees, and am sure they cant have every agreement I have ever signed. I only the last one I took out was the Topshop one to replace an older one, they claimed at the time the interest was lower.
I believe Santander took over from GE capital, so their records may not be upto date... hopefully.
Advice please on how I should proceed.
PS Not looking to stopping payments, but would love any advice on how to enforce my rights.
There is no such thing as a 0% credit card....... someone out there is paying for it, and for once its not going to be me.
PS I used to also have a BHS card which was also GE but not sure on how to proceed as this is now closed as I didnt take up their transferal to CC when they abolished storecards last year.

You need to do both. Send off a CCA request with a postal order for £1.00 made payable to them. Do NOT sign it. Also send in a SAR request with a postal order for £10.00, again you can sign this document but if you sign any document I'd advise putting a line through your signature so it cannot be 'lifted'. I read that on here somewhere.
I am not sure but I think you would have to this individually as Santander now own Dorothy Perkins. I'm a relative newbie myself and I apologise I cannot help further.
subbing to your thread with interest (opening my own thread shortly). I sent off a CCA request to Santander regarding my DP account, the copy they sent back is laughable and unreadable. Stalling tactics me thinks.
I'll keep you posted as to how it goes but in the meantime if you don't have the address for Santander, I can happily give it to you with a contact name.
