    Default Unauthorised Search - I think this may be serious

    Hi all new here,

    I couldn't find an answer to my question as it's a tricky one. So I thought i'd post.

    I looked at my credit file through Experian yesterday. And under 'other searches' there are 3 searches by an estate agents in my home town. I have never had any dealings with these estate agents, but after a bit of digging online I was able to find out that my ex partner Is a manager at one of their offices. The searches were carried out in December 08 and then 2 on the same day in July 09

    Can she do this ? She has obviously carried out a search for personal reasons using her place of works Equifax account.

    One of the searches is against our old address where we lived together and she still lives at. The other is against an address I lived at after we split.

    She has a ccj against me that I am disputing and not paying – does this give her a legitimate reason to run a search on me through her company account ?

    Where do I go from here? What are the consequences to her?

    Any help you can offer I would be grateful of.

    This seems to be a breach of the DPA and also I expect that it is a serious breach of her employment T&Cs.

    Make sure that you keep copies of all of your searches.

    You could write to her by recorded delivery and point out to her the seriousness of the action whcih she has taken and that you are proposing to report her to her employers, to the CRAs and to the IC. Make sure that your letter doesn't look like some blackmail letter. However, she may decide to come to the table and negotiate with you.

    On the other hand, you could simply go ahead and make the complaints.

    Thanks very much fodder that's good advice. I think i'll speak to the credit ref agencies this afternoon - if anyone else has any further advice i'd be grateful.
