I am really at my wits end with Lloydstsb.
Me and the wife took over the father in laws accounts as he ran himself into about 10k worth of debt after his wife passed away and isnt able to cope with his own finances.He is a little illeterate and thus we decided to help him last year.We have had no problems with some of his creditors apart from LLoyds tsb where he had a loan and a bank account both in arrears.The loan we set up an agreement to pay 30 pounds per month and this is on a 6 month basis renewing every 6 months and havent had any problems until now where they are starting to send him nasty letters stating that he has not paid the original amount and are threatening to take him to court.Although all the agreed payments have been made and the current 6 month arrangement doesnt cease for another 3 months.
Now his bank account was in the arrears of approximately 300 pounds and we have kept up with all the payments with a reducing balance on the overdraftevery month.However there was a missed direct debit
which was taken out once a year which we didnt know about and the bank walloped him with overdraft charges and daily charges.We then got the father in law to go into his local branch and stop all payments made out of his account back in july which i have the letters and re set his payment schedul up.The point being we had made over 200 pound in payments and his account is still at minus 317 due to charges.In september they done the same hitting him on charges where there was no payment coming out.I had to demand to see someone in my local branch and believe me if its a collection centre letter no one in branch will see you.I was forceful and after waiting an hour i made an arrangement to see someone a few days later there and we then set up all the repayment schedule again.
To my dismay they have just sent him a letter stating that there was a payment request again in october and they have hit him with charges yet again and his account is -500 in arrears again.
You cannot get an proper answer as their call centre is in mumbai and when i did speak to someone they said there was no direct debits or standing orders set up on the account and to phone back wednesday as they would re credit the account and the chap said he would oput a note on the account to advise all other calls.
Last night was the final straw he was getting threatening phone callssaying his account was over the arrangements and like my father in law always does he referred them to me and the phoned me but wouldnt speak to me??
Now considering i have full written access on his account which has been confirmed on numerous times they would not speak to me without my father in law being present.
How can i
1)Get the lloyds tsb to stop pestering my father in law as i have legally verbally threatened them with harrasement before
2)Get all charges stopped and re imbursed
3)i am prepared to take this to court as he is being treated unfairlyand wrongly as he has kept up all agreed payments
4)The father in law is in bad health and is unable to deal with this type of harrasement the bank know this and yet still pester him
if anyone could point me in the direction of the right legal letters and if anyone has a direct uk phone line to speak to someone in this country at the lloyds i would be grateful
