    Default Fry V Woolwich Claim No2 (small Claims)

    first lbaicon letter sent 1st july £11,017.50

    reply 5th july sorry blah blah blah looking into my complaint and will get back to me 31st july. (wot its not a complaint!!!)

    again another letter 31st july cant respond fully to my concerns and will get back to me 29th august. (huh dont think so!!! c u in court!!)

    tough had long enough filed my claim on the 19th july for £13,623.58 in fast track obviously!!! (oh err wibble wobble!!)

    claim served 24th july

    they acknowledged on the 25th july and have further 28 days to reply from the 24th

    they have until the 21st august to enter a defenceicon

    not heard anything yet so praying very hard to hit that button on the 21st august

    to say the least my nerves are very very jangly!!!!!!

    Its normal but nothing to worry about.

    You have done so well,and on the lat hurdle.
    The waiting part is not easy.......but the light is there at the end of that tunnel.

    Hey please don't feel nervous. The first thing you have to remember is that you have done nothing wrong. You are the one suing, you are not being sued. You are not the defendant, they are. All will come good in the end!

    i know matey!!!!! but hopefully got the tool of disclosure ....that will help!!!!

    anyway had a letter off head office to offer me £1,000!!!!!!!!!!!!! against my £13,000 odd .... what are they kidding!??!!! not accepting that.:o ..in any case have already filed claim....so as said before c u in court barclays!!!!!!!!!!!!!

    Tell them you will accept the offer initially - but for a different reason. Tell them
    you need the grand up front because you intend to hand make, using fifty pound notes, the finest cigar in all the land. You will need it to celebrate when the other 14.5K rolls in. Maybe create a signatureicon under your claim so I can keep track??!!

    PMSL ......ok will sort of think of signature tomra am knackered from all the letters im writing!!!
    do i put what claims im undergoing and what stage??? havent done a sig before!!! lol

    well had sum flipping fantastic news today. this claim was suppoosed to be in fast track but its NOT horray horray in small claims and ive got standard disclosure horray horray!!!!! thanks to johhni 2 bad info in the library on aqicon...

    god one happy bunny!!! have two hearings in same week one on the 25th and 27th october 2006 both with woolwich....

    nice bottle of wine chilling for when the sun is over the yard arm tonight!!!!!

    great news lobster,perhaps the judges are trying to subtley persuade the building societies to settle early.let's hope so anyway.he's certainly helped you and by some of the things i've read on this forum you're not the only one judges have given a small helping hand to.

    thanks for replys guys...havent got the forms yet karne..went to court today to find out...i didnt beleive them but they showed me the screen....

    lester the woolwich is no longer a building society hasnt bin for ages...

    i havent got the foggiest why mine in small claims well i did ask. also have 2 hearings fairly quickly in same week at the end of october whereas squishy has hers in dec same court same judge and she did her aqicon before me... god knows how they allocate these hearings a tad unfair i say .....and hers is all day mine only 2 hours...strange .. strange... be interesting to see how quickly i get my hearing for Abbeyicon. aq in on monday...

    That is really excellent news.

    I wonder whether the bank might try and challenge the allocation? Most unlikely - and even more unlikley that they will make the disclosure. I expect that they will attempt to make you larger offers or apply conidtions.

    However, with a small calims track allocation and standard siclsoure I would suggest that you are in an unassailable position - insist on your full claim uncodnitionally including all costs and interesticon calculated right up to the date that the cheque is issued.

    If there are any unusual developments please pm me with a link to this thread.

    If you happen to get dislcosure then I'll come round personally whereever you are!!

    By the way , don't forget that you are bound by the disclosure order as well so you will have to start preparing for this and make sure that it is done properly and on time.

    Jonni2bad has some experience of this so pm him for an inital list and pm me when you think that you have put it all together.

    Do not leave this to the last moment.
