Barclay card taking money from account without permission!!!!
Hi there,
My partner has recently had a part-settlement on his bank charges with Barclays due to a financial hardship claim.
He no longer uses his Barclays account, and they refunded the bank charges to that account.
He owes Barclaycard some money, and he hasn't paid them for a long time (due to being in and mostly out of employment for a year).
Now, the money has gone into his Barclays account, and Barclaycard have taken £500 (presumably his arrears) from his account without his permission?????

The banks have, and use, the Right to Set Off, as you have found to your cost !!
Roughly how much was refunded to the bank a/c, due the the Financial Hardship claim.
I would write to BC pointing out that the refund to your bank was made because of the hardship you're experiencing, and that they have no right to take the money in this way. Tell them you're reporting this to the fos.
See how they respond.
I'd also make the formal complaint to the FOS.
If there are penalty charges on the BC a/c, these can be recalimed in full without the need for a Financial Hardship claim.
Claim interest on the charges at BC's Contractual Rate by way of a court claim and the amount you get back will be considerably more than the charges alone.
