    Default BillHicksGhost vs Mint

    Hi all,

    I am hoping I can get a bit of help. I recently sent the CCA letter to Mint. They have responded but I'm not sure if what they have sent me is enforceable.
    Basically I have uploaded the two main (I think) parts. The sheets were separate on one there are no dates and no page numbers to show the documents are together






    Any help would be really appreciated

    The second sheet is new, its the varied agreement, as it lists the default charges at the post April 2006 levels.... so the important document is the first sheet.

    Will see if I can get someone to take a look for you.

    If you are finding it hard paying the balance, or are in financial difficulty it might be worth trying to negotiate a settlement with them, or approaching someone like CCCS for advice on the situation.

    I have been looking at this a bit more and what should I make of Section 61(a) of the consumer credit act which states

    “A regulated agreement is not properly executed unless-” it …”is signed in the prescribed manner both by the debtor or hirer and by or on behalf of the creditor…”

    I know its not what you want to hear, but some courts unfortunately consider a stamp as the companies signatureicon on the document.... though I would suggest PMing steve for confirmation on this.
