I switched to Smile over a year ago and have experienced a number of problems, not least their draconian charges. I had all my direct debits set up for my pay day which was the 15th of each month and I suddenly started being penalised for unauthorised overdrawing. What had happened was that Smile took all my DD payments on the 15th ( which included my mortgage etc) and then a nanosecond later credited my salary. But for a nanosecond I was overdrawn and hit with fees. I discovered this after several months and raised it with Smile who said it was in the terms of my agreement etc and refused to refund. However I soon found that I was in a spiral of charges and ran up an overdraft of £750 which consisted entirely of their fees.
But after reading media reports and finding this site I decided to take them on. On the 30/6/06 I sent my first letter claiming £990 in unfair charges and on 19/7/2006 I sent my letter before action.
On the 27/7/2006 I recived a letter from Smile advising me that following a review I HAD £990 REFUNDED TO MY ACCOUNT!!!!!
They apologised for the delay and went on to say that if they did not hear from me within 8 weeks they would assume I had accepted
So if you are angry at their charges dont wait any longer - send the letter!!
