    Unhappy Help with failed claim for Barclays loan

    Hi can someone offer me some advice please

    Took out a claim for miselling of PPIicon on Barclaysicon loan though a company, paid the solicitors involved £495 for the privilege. Waited approx 3-4m only for the solicitors to write and confirm as you don’t remember any discussion regarding PPI Barclays say you have no claim.

    Can some one advise me as to whether they think I will be able to get any money back out of the solicitors and what the best method is to approach this, i feel that they should have known if i had a claim or not and just took my money as a quick buck

    I am going to write to them and ask them to provide me with a copy of all correspondence etc to and from Barclays and take the claim up myself (which I should have done anyway)
    But will I have to repeat the process direct to Barclays or can I merely refer this straight to the fosicon once I’ve obtained all the correspondence from the solicitors/Barclays and made sure they have done what they should have

    Have people managed to have much success with claiming back via Barclays and if so what was the best route/stance to take

    Thanks in advance for any assistance

    Look in the stickies at the top of this forum. Read all the threads and links and get ready for a fight with Barclaysicon. You must be prepared so study and if you have any questions just post and you should get a response to assist you further.

    The general message is do not use claim companies or solicitors or anyone else on PPIicon reclaiming you can do it yourself and the only cost is postage and a £10.00 fee for the SARicon. Any advice is free and mostly from caggers who have claimed and won either through the Financial Ombudsmanicon Service or directly to the bank, credit card company, mortgageicon provider etc.

    Put in complaints to these websites (sadly they are temporarily unavailable)

    Your rights - Complaints against Solicitors

    You can just do a google search on complaints about solicitors and bingo you get results. This should help you to complain about the solicitor (If they are legally registered) to the regulators which may help you recover your £495 fees.

    I have a complaint in against Barclays at the moment and am awaiting a response to my claim within approx 5 weeks.

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

    Not sure which shocks me the most, Barclays continued arrogance towards their obligations, or the solicitors incompetence.

    Dont give up on this. The burden of proof is with Barclays, not your memory.
