Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Ok guys will try to explain the best i can with the info i have, having just got of the phone to my friend in a right panic over a phonecall she recieved this evening from what i can gather from Lloyds collections dept.
My friend has 2 accounts with Lloyds
Account 1 has her wages paid into
Account 2 she had set up for her standing orders, this account had also had her tax credits paid into, and a monthly amount transferred from account 1 to cover her loan and private pension and a savings plan.
with me so far
The guy from the collections dept has just told her that account 2 has been closed since june and she is £900.00 behind with the loan, this is the first she has heard of the account being closed, also the working tax credit payments are still being paid into to this account so for 3 months money has still been paid into this account but where has it gone :-?
Will be doing a SAR for her, and told her to open a parachute account,
btw she has recieved nothing from lloyds to inform her of any arrears or closure of account, any advise would be welcomed guys
Will be doing a Subject access request for her, and told her to open a parachute account,

I think you've done all the right things so far , and although it will of course give your friend all the correspondence they have on her -it'll take time for a SAR to come through.
The parachute account needs to be opened asap to stop them from plundering her money ......
Meanwhile she needs fast answers from Lloyds on :
1. Why they closed the account
2. what notice did they give her of their intention to close the account
3. What has happened to the money which has gone in there since the account was closed (she should be able to confirm with the tax office that those payments were not returned to them marked 'account closed' )
This letter needs to go as soon as possible , recorded delivery of course, to :
Customer Care
Lloyds TSB 125 Colmore Row Birmingham B3 3SF
She should also consider reporting them to fos and Trading Standards if they have just closed her account arbitrarily .... but I think FOS like you to have exhausted all avenues with the bank first ....
Of course , the letter she sends should also point out that the accounts are 'In Dispute' and until they are resolved she cannot address the re-payment of the loan ... (and the SAR should also throw up a CCA for the loan , so there may be scope for manoevre there too ... )
If I can help further Tills - you only have to ask
Nemo me impune lacessit

Will put a letter together for her as you advised, from what i can also gather they have applied charges on top as well, me thinks ive got my work cut out here have told her if they ring again tell them she wants everything in writing
Oh where have the account in dispute letters been hidden
At this stage the account is not technically 'In Dispute' until she sends the letter asking for explanations , so just add a bit saying 'until these questions are resolved I consider that these accounts are 'in dispute' and any action to pursue payment should be suspended until this is done '.
You could add that failure to satisfactorily answer these questions will be reported to the fos and Trading Standards ....
As for the charges which may have been applied , once the SAR is received she should be able to work out how much they've taken and set about claiming it back .
If you need help with that ,come back to me tills ....

Quick update, new account has been opened and everything has been transferred from Lloyds to new account . Both the SAR and the letter for an explanation have been sent.
Update
Have been in touch with friend, she has recieved data back, but only from 2004/2007 for an old loan that was satisfied which also had PPI, nothing has been sent for for the 2 bank accounts and current loan.
Will be firing off a letter of non compliance.
