Hi, currently in arrears with my loan with Nationwide. I had arranged to get the agreement declared unenforceable and written off unfortunatly its enforeceable.
Anyway, got a cheque back from the solicitors for all the arrears i have paid them as monthly installments. question is however, I had a default issued when the debt is in dispute. I have copied in the default below.
They seem to be asking for the whole amount as opposed to the arrears, they have not terminated the agreement, however, Freddy International is after me. Is the default notice right? Also, can I just pay the arrears and then reinstate the agreement?
any help appreciated.

They are asking you for the full sum, not the arrears to bring the account back into normal mode AND
They have given you not enough time to remedy the default.
12th June to 26th June is 14 days but what about postage time
2 DAYS FOR 1ST CLASS, 4 DAYS FOR SECOND CLASS

Keep quiet about the default until they terminate then they can only get you for the arrears (unlawful recission of contract)
Doesn't matter if you clear the arrears now. Your credit file is stuffed however, once they terminate (if they ever do), You could demand they remove the default as it was invalid (this is opinion only unles someone else can confirm)

sorry to be stupid, but is the arrears payable when the contract is terminated the arrears at the time of the default rather than the arrears accrued up to date of termination?

Need some major help here now. Bryan Carter and Co Solcitors have written to me giving me 14 days to pay the whole amount (yeah right) or to contract frederickson international with my payment proposals.
If not, they will commence legal action and rather avoid this hassle. need advice on whether to write to frederickson international and offer repayment proposals with interest frozen ie was paying 177.43 a month, if I pay 200.00 a month this would be better. Or, do I wait for them to terminate the contract and get them for unlawful recission of contract.
Any help will be greatly appreciated.

What we don't know is if the account has been sold to Freds. Did you not get a "Welcome Letter" from them?
If the account has been sold then the account must have been terminated
If they are collecting on behalf of Nationwide then if hasn't been sold.
I think A CCA request to freds is in order (just a slowing down manouvre) and a SAR to Nationwide to find out where you stand.

Freddy are acting on behalf of Nationwide. will send cca request through. Should I send a copy of the letter to freddy through to Bryan Carter to slow them down further?
If it goes to cout on the back on the faulty default notice, is this significant ie. can I delay ever further by claiming dodgy default notice or do I make an offer of payment to freddy?

you should have written accepting their unlawful termination do it now if you have not done so already i would write and tell them that you are still waiting for them to confirm the amount of true arrears (not including unlawful charges) that were outstanding at the time that you accepted their unlawful rescission, , against which you may have a counterclaim for damages
dont write the letter to carter- send it to Nationwide- dont send it recorded send it proof of posting and staple the receipt to your copy of the letter
I have just called Nationwide after 4 months of paying freddy £50.00 a month to keep them sweet. They have said they have sold the debt to Frederickson International and thus have no further interest in the debt.
However, I did not receive a welcome letter from frederickson international, they said they are acting on behalf of nationwide.
Does this mean they have terminated the agreement?
If so what happens after?
