I sent a SAR request to RBS re 3 old loans. They have advised me that they cannot locate the loan docs, however they have told me the loan account numbers.
I am confident they were single premium policies. Can I still lodge a complaint on this basis and see what happens?
They refunded me on one of my loans recently and I just provided them with the loan number and based my mis-seling case on the single premium policy.
You could respond by asking them to carry out a complete manual search of their archives and if that does not produce anything you could still go ahead and claim.
You can also complain to the Information Commissioners Office about the failure of RBS to supply you with a comlete set of data. I find it difficult to believe they can produce the account numbers but no documentation for the account numbers.
Keep at them IMO.

Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.

PPI Claims ongoing with:

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
I have gone back to them and stated that the policies were mis-sold. Both were taken out at the Branch and no mention of the implications of PPI/single policy premium mentioned etc etc.
I believe if they have the sort codes/account no's they have the info.
They basically argued that they do not hold my info in a relevant filing system and as such my request is outwith the scope of the CC Act..
