Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
In February of this year i wrote to Citicards complaining about the mis-selling of PPI on my credit card. They eventually wrote back in August of this year after about three holding letters and refunded what they said was six years premiums and interest. This amounts to about 30% of my calculated claim.
In their reply they quote the statute of limitations and will not go back further than six years. This looks like my biggest stumbling block.
The fos will not touch this as citi were not regulated at the time the card was taken out(old associates card).
If your card account was closed theny they are only obliged to keep records up to six years after the last transaction on the account. But in the current climate of mis-selling PPI big time I would tend to push them for full disclosure of all the data they hold on you as a data subject. If they then state they do not have the information ask them to produce valid certification by one of their data officers showing what data was destroyed, by whom and when. I would suggest you get them to certify this to you in writing.
I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner. ------------------------------------------------

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
