LDG vs Barclaycard

Thought i'd add another claim to my ever growing list.
I sent off my SAR icon

a few weeks ago and hey presto it arrived this morning!

Excited i was, although only to be a small claim icon

this time, until i opened the A4 envelope to find only copy statements and nothing else!!
It has no copies of communication, no CCA or terms and conditions icon

, just the statements.
i'm not a happy bunny now.

I've just been through the forum and Barclaycard is popping up all the time recently.
Each thread i have seen states that no CCA has been received by the consumer after sending the full SAR icon

.

I'm writing a letter of non compliance as we speak.
2 questions.
1. What happens if they cannot provide the CCA
2. PF good buddy i see that you have worked out APR for another Barclaycard claimant, could you do the same for me?
Monthlypurchase rate of 0.709%

no cca debt is unenforcable until they can come up with one in the noncompliance letter add a ref about the fsa's latest update yes i can help with the figures ill be back this evening with links 4 u as i cant post them right now as im using phone browser

Right as promised here is the FSA links relating to fair redress:

Have a good read of the booklet in the second link as im sure it will help your complaints.

Now as to your next calculation as this is a credit card all i need to work this out is date of each PPI payment and the payment.

I asume you want it worked out on the rate posted above ?

I'm not asking you to work out all the figures for me PF. You are probably inundated with other claims. But you are very kind to offer for me.
Through your good advice on my creation claim i've really got the hang of the calculators you linked me to so i shall do my best on this one. But i may ask for advice here and there.

I just need help to work out the actual APR by going on the monthly rate above
Is it just a case of multiplying the figure by 12?

Enter the interest rate % convert Monthly to Yearly Yearly to Monthly
If your monthly interest is 0.709%, that means an annual rate of 8.85%

I certainly will do PF.
Thankyou for that. As i said earlier it is only a small claim icon

but i'm thinking if i win a small claim it helps to fund my bigger claims. The amount spent on postage and SAR icon

's is adding up

Indeed and as the FSA has said the financial sector has to start sorting their house out otherwise they will be handing out bloody noses.

Sorry to ask again what did you mean when you said no CCA is unenforcable until a creditor turns up with one?

If the creditor cannot produce a credit agreement the debt is unenforceable ill find the link for you on this subject.

A second question, i'm going to also send letter of non compliance from Alanalana's template.
It says if they do not comply then i will take them to the county court icon

Just worked out the claim.
PPI icon

plus compound plus simple total £194.48
Charges plus compound plus simple £273.98

Grand total £468.46

That would clear half the balance of the card!
Not bad
Thinking that as they have not provided a CCA then maybe that should be my bargaining tool?
