Yes, if they make you bankrupt they have to pay the fees, if you go bankrupt you pay the fees upfront before the hearing.

Any chance the debt may be statute barred ? i.e. you haven't made any payments towards it for at least 6 yearsicon ? (5 in Scotland)

If it isn't statute barredicon are your total debts below £15k ? If they are have a look at Debt Relief Order - Wikipedia, the free encyclopedia

hi no debt is only 3 years old and have others which add up to about £25 k in total was self employed till a year ago then became ill so just have pension credit now thats 130 per week so really does not make much odds to me if they do want to make me bankrupt as i am not likely to want credit again anyway

Have you tried going through the CCCS instead? Capquest might take more notice of a nofitication from the CCCS than they will of you making the offer yourself. I found that previously.

Yes, CCCS is a free service. They are very helpful indeed.

CCCS - Free Debt Advice from the UK's Leading Debt Charity

Give them a call and they will arrange a suitable time to call you back. They advise you on the best steps for your situation and if a debt managementicon plan is the best option for you, then they write to your creditors with an offer for each. Thereafter, your money goes directly to them and they forward it on. They become the first point of call with your creditors also.

Just give them a ring really, they can talk you through everything. You say this particular debt is 3 years old. What about the others, and have you tried CCA'ing them at all?
