I am trying to help my partner sort out their finaces and have started to request agreements from several cc companies using the cca route.
This thread concerns Barclaycard.
They replied to the cca request with two letters.
The first was a photocopy of their T&C's from 1998 (two pages)
The second was a copy of their CURRENT T&C's.
In the first covering letter it stated 'Under Section 78, we must supply you with a copy of your executed agreement and a statement of account which is practible to refer.....

A copy of your current Barclaycard agreement will be sent under separate cover'.

From what I can understand from this forum this is the latest tactic by BC.
My partner is also receiving letters from 'DCA's'; firstly Mercers then Calder.
My partner is not speaking to DCA's by phone and has requested everything in writing. Although they seem to have stopped since the cca request.
So, what is my next step?
SAR Barclaycard?
Dispute the account?
Tell the DCA's keep your nose out?
I will be posting under the other forums regarding the other cc's etc.
If there are penalty charges or mis-sold PPI on the a/c, you should claim these back. If you don't have all the last 6 years' statements, send off a SAR with the £10 fee.

If you're serious about wanting to get sight of the credit agreement to see if the a/c is enforceable, read the CPR strategy thread at Link No 2 in my signature below.
But don't bother starting with the first 2 letters unless you're prepared to follow through with the necessary court application.
