Sometime last month or late June I wrote to A&L Credit Card informing them of my intention to recover unlawful chatges etc. I also informed them that the account was in dispute.
They replied with the usual fob off letter, but offering £100 as a goodwill gesture.
I then received a letter asking me to pay the arrears or face action. Then another letter asking for the same amount but with a different account number. (I have only ever had one account with A&L)!
I then wrote back accepting the £100 but only as a interim payment against a future claim. I also pointed out the problem of having received two requests for payments with different account numbers.
Next I get a letter offering a further £1100! This was for Full and final settlement. Bearing in mind that I had not even sent a DPA request yet.
Now I have received my latest statement and it shows:
Adjustment to Balance £100
Adjustment to Balance £380
Adjustment to Balance £380
Adjustment to Balance £350
Adjustment to Balance £350
Adjustment to Balance £400
A total of £1960 refunded! This leaves my account £198.07 in credit. Although I have not had a card from A&L for at least 6 or 7 years, so I can't spend it!
They are flustered with requests and clearly under pressure.
I suspect this is someone elses payments.
Its not too difficult to see how a mistake like this could happen at the moment.
First thing that needs to be established is that this is clearly not your money and however tempted (though I am not saying you are ) you may be to keep it,the implications of doing so would be serious.......in fact it would be theft.
The only course you have is to inform them......maybe write them a letter saying that you are a little more honest than them !!
This may or may not give you some leverage with your claim.
