    Default Egg Court claim

    Hi there,

    Sorry to start a new threadicon but it is a different Eggicon topic.

    Egg agreed to pay back my PPIicon as it was clearly dubious but are holding out on charges. We are currently at a deadlock, they have issued their final response of NO!

    I'm trying to decide what to do next. I've started filling in a MCOL for the remaining charges which will happily reduce my balane to 0. However I would also like to look at getting the default removed as it was due to dodgy charges.

    Is there a particular way round that I should do this? Do I claim the money first then sort out the default or does it need to be done at the same time?

    Any help on the best approach would be appreciated.

    Natwest Credit Card- £850- WON!!!
    Natwest Current Account- £380 (in 1 month!)- On Hold
    Mint- £250- WON!!!
    Egg- Still waiting on list of charges
    CAP1- Still waiting on list of charges
    HSBC current account- On hold
    IF- waiting...

    I'm in a kind fo similar position, though in my case they havent said "no". But faced with a claim for over £1000, they offered £56 (the difference between £20 and £16 for the 14 occassions on which they charged me the former rather than the latter), which might as well be "No".
    I sent them off a copy of court papers I have prepared and told them that if I dont hear from them by the end of next week that they will be be getting put into court. I THINK I have read somwhere on here that faced with Court papers, Eggicon dont even defend - they just pay up, so some sort of raising of the stakes was necessary - Court or through the fosicon. I posted on this conundrum and got a reply from Maroondevo that he had used both FOS and court with some success - http://www.consumeractiongroup.co.uk...ml#post2482617. So I would suggest that you arent going to get anywhere further without raising the stakes a wee bit (ie Court or FOS). Which one is better? I wish I knew that too

    Thanks seriously. I think the offering the difference tactic is worse than a refusal, its two fingers up to the customer! I agree that the stakes need escalating but my concern is when and how to demand the removal of the default.

    I read the case where someone put them together and won on a technicality that they agreed to settle the whole claim but Eggicon ignored the default issue. I would say they wouldn't make the same mistake twice but you never know. Good luck with your claim.
