    Default Data Protection Act

    I have written to Barclay Card requesting details of all the charges put on my account over the last six years. They have written back saying that they will supply me with copy statements at £3 a go. Six years worth of statements would cost a couple of hundered quid.

    I remember reading about the Data Protection Act, could somebody just explain my legal position with regards to getting this infomation so I sound like I know what I am talking about when I write back.

    Make a request under the DPA (1998) informing them that they have 40 days to comply or you will inform the information commissioner of their failure to comply with the law. If they are of any doubt that the information is covered by the act, point them at the Durant vs. FSA case, where the judge ruled that bank statement information is indeed personal information and thus covered by the DPA.

    The maximum they can charge you is £10 - I had no trouble getting this information from Barclaysicon - they just sent it straight away and they didn't ask for any payment.

    They tried to catch me out by sending my 10 years instead of the requested 6 - probably in hope that I would start a claim for the full 10 years, which they would probably have had no trouble striking out.

    Please please read about it on the forum. It is in the FAQs and the rules of engagement. Also it is constantly referred to in other threads and alos in the library there is alink to the Information Commissioner with lots of pamphlets with all of the answers there.
    I asking you to do this only because these are the sort of basic questions which are asked many times per day. The FAQs etc and the whole forum are there to allow people to read, inform themsleves and then come back and ask questions. It is very difficult for us toe deal with so many repetitive answers.

    You are right. the answer is the DPA. It's easy and cheap. have a rea and then come back here.

    I also requested this information on 28th December 2005 by fax, and got a standard 'we are looking into your issue' letter 7 days later. However I have had nothing since. So on 6/2/06 (the 40th day) I sent them another fax saying if I dont hear from them within 7 days Im going to report them to the Information Commissioner.

    Today I also rang BC Cust Services to see if there has been an update, but the lady said it was being dealt with. She asked me what the problem was and if she could help, and i briefly explained that 40 day timescale has run out. She told me not it was 40 days without counting WEEKENDS, lol, bless her!

    Anyway, I told her im going to complain on Monday, so if i dont get anything by mondays post, you will be reported BC!
