    Default multiple defaults for one account

    I have an Eggicon and cahoot credit card which I defaulted on both in 2005. The debts were subsequently sold on to Lowell. Since Lowell became involved they have been making entries on my CRFs. The original defaults from egg and cahoot are also sitting on my file.

    My understanding of the Information Commisioners Office technical guidance for filing defaults is that when a debt is sold on, the buyer must either take over responsibility for the existing CRF entries, or the original creditor must mark the entries as satisfied and the buyer does not make ANY CRF entries at all.

    Has anyone had a definitive answer from the ICO on this?

    I hope you get an answer, because I have been asking the same question. Link have a default registered and they bought the debt from MBNAicon who also have a default registered. Writing to the CRA got me nowhere.

    If a DCAicon buys the debt legally then it is the DCA who should register the default and the original creditor has to remove their entry.

    If it is still with the OC then the DCA cannot register another default.

    Only one default per account simple as that. Also if a DCA does buy the rights to the debt the default still has to show the original date of default they cannot start it from they date they bought it.

    I asked equifax to remove the cahoot record. They contacted cahoot and lowell but received no reply within 28 days so removed it. I have challenged the two defaults for the Eggicon account and they are doing the same process.

    What if the DCAicon or OC contacts the CRA after the 28 days will the default reappear?

    potentially yes, but there would only be one default as opposed to two.
