Advice re: Defaults, Debt Management when claiming
Hi everyone
Hope I am putting this on the right thread.
I have read all the FAQ and browsed through the site and wondered if anyone could give me some advice regarding my situation.
About 3 years ago I became snowed under with debt. I had a credit card, loan and 2 current accounts with Barclays Bank. I then defaulted on some of these and signed up with a debt management company.
I have a SAR letter ready and waiting to go but have a few questions.
a) do I need to write to all of them individually or is it simply enough to address it to Barclays Head office and list all of the above (loan, cc, current) and ask for the statements relating to all of them
b) how will this affect my current agreement to pay them ie: can they ask for the whole amount bank.
I already had another bank Lloyds which I am not asking for charges back from.
Any advice? Anything I should be particularly careful of doing/ saying?
I read in FAQ to tell my DManagement company about my intentions which I will do.

Forgot to say that the current account and loan was passed to Central debt collection Agency and I think Barclaycard credit card still is dealt directly.... incase that makes a difference.

You can ask, for ALL information that is held on you for your SAR - DPA request, But also include Account Numbers etc
I would take it as being a Barclaycard - Which is separate to Barclays, And posibly the Loan may be separate - I stand to be corrected if wrong - Please Advise here.

If you Owe them monies still, it would be best in my eyes to pay back the charges back to each account, knocking your balances down, and Knocking the Debt mountain down.
But I believe you could ask for payment by cheque

Just follow the guidelines and Instructions on this site, and follow deadlines, keep accurate records of what you send and recieve, and you should not go wrong

I told my DMC - Payplan, Not with now - I've taken control again, They did not seem bothered, Then again, they take weeks to reply back to emails and letters, Not received a reply back from a fax sent on the 18th July, Have they not noticed I've not paid
Hope you got a better DMC than Payplan
Its a waiting game, do not expect money back in a week, could be months - possibly around 3 months if court action is started

Have you been Officially informed that the debt was passed on to a DCA - that should of been done by Barclays

Just a note, although you may have a debt with the company your claiming from, one of the cornerstones of your dmp is that all your creditors have accepted a repayment based on the proportion of your overall debt that they own.
SO I would insist that part of your claim should be that you get paid back by cheque, otherwise reducing one lasrge debt signficantly may well upset the apple cart. Edit : this means you can allocate proprtionally the money you get back to all your creditors.
This is only a personal view others may have more knowledge or experience.

MBNA are not your friends, they will settle but you need to make sure its on your terms -read here Glenn Vs MBNA

Yes I would think a cheque would be better as also a lump sum would enable me to negotiate paying off a whole debt sooner with a better settlement, which I did recently with another DCA and got 1/3 knocked off my debt.

Yes as the debt is now paid monthly to Central debt collection Agency.
Yes I do have charges but I also have a substantial credit card balance which I could not afford to pay back immediately should they close my accounts.

Should they close your accounts, they could ask for payment, but as you are in a dmp anyway, that debt would then be dealt with by them
So its up to you, are the charges worth that much to you, You be surprised that once you start adding them up, it can come to sevral hundred or even thousands, before you even realise it
But I'm not pushing you to do Lloyds also, that is your choice
