Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I defaulted on this earlier this month and have been playing e-mail ping pong ever since.
I have offered what I can afford. They say 'computer says no'. Computer then churns out standard e-mail, I reply with what I can afford and the cycle starts again.
They 'note' my situation, but my offer is unacceptable and appatently desperate to speak to me!
They have no current bank details so there is no way they can get hold of anything.
Am I best to keep playing their game until they sell to DCA?
Hi Plum, I am in a similar situation to you, although you are a bit ahead of me in that I have only just defaulted. I am trying to gain some understanding of what action I am likely to face and how I shall approasch it.....Could you tell me how much QQuid have added to your original total loan repayment amount in interest/default fee/charges etc since your default? Good luck with it by the way - I shall be watching out for your progress and will appreciate any updates you make!

Hi
They have added on another months interest, but no 'default fees' as such yet. (although I suspect they are getting round this by calling it interest) They don't explain that this is what they are doing either. I was persistant and asked how they got to the figure they have.
They will try to blind you with science and waffle in 'template' e-mails. It will feel like you are communicating with a brick wall! Don't talk to them on the 'phone.
If you haven't already I would suggest you change your debitcard / bank account so they can't go trying their luck.
From what I can gather they will eventually get fed up and pass to a DCA. People do seem to have come to payment arrangements with them, but only if you can pay it in 3 months, which I can't
Stick to your guns, keep everything in writing and you'll be ok
I have been trying to set up a repayment with quickquid for 3 months! They always send the standard "your situation has been noted, and collection procedures will continue" e-mail, however, today they have advised me that the debt has been passed onto mackenzie hall, and from what i can gather they sound like a nightmare! will just have to wait and see what unfolds, at least its interesting if nothing else!!!!!
I have had email saying they have passed to Mackenzie Hall They are bullys.
They also buy old SB debts.
I CCA'd Quickquid and they never got back.
If Quickquid have your email address then expect email From Mackenzie Hall I got one asking if I was the person (name) and to contact them and if I wasnt could I contact them. I didnt contact them and put them on my blocked email list. I suggest you do the same.
Yeah it does appear to defy common sense, not that sense is common anymore!! Surely something is better than nothing, and informed them so, although it does appear that they pretty much ignore everything you offer!! Quickquid will do nothing until your loan is 90 days overdue, then they will send you an offer of a reduced full and final payment. I owe £637 and they offered me £478. I explained that i would love to accept that but i just simply dont have the money. They have now passed me onto mackenzie hall, so far i have had one text and one e-mail asking me to get in touch, so i have sent an e-mail offering a repayment plan of £30 per month for 6 months, then the remaining balance to be paid off in two monthly payments of approx £225. Seems very fair to me, but as with quickquid i have heard nothing back, and that was a couple of days ago!!! What is wrong with these people, why do they never reply!!!! Oh well, could be worse i could be getting constant phone calls etc. Will keep you posted, as it seems i am about 30 days in front of plumfairy. you can relax for at least another month!!!
I received text and email for Mackenzie Hall I didnt replym did they ask if you were the person they were trying to contact?
The reason I didnt reply was that I asked Quickquid for a CCA and they never replied so account is in dispute so they shouldnt have sold it on.
Yes, they did ask if I was the person they were trying to contact. I did respond because I want this sorted, as I told them, I am not trying to hide from the debt and want to pay it off. Quickquid, have not added any extra on the loan, ie default charges, so I am happy to pay what i owe, however, this simply refuse to accept any kind of resonable payment plan. I am hoping this DCA will be more acceptable, but as they have not even responded I am not holding my breath!! It baffles me really, because I had a similar loan with Pay Day UK which I defaulted at the same time, and after a little haggling we came to an arrangement quite quickly, I now only have three payments left and then it will be paid off, very easy to deal with, very courteous, and come December very paid off!! Why, Quickquid didnt accept my offer is beyond me, as from what I can gather the DCA will have paid much less for the debt than I was willing to pay!!!
I believe they are, not found anyone who states otherwise! I am no legal expert but there are thousands of people on this forum who are far more clued up than me, and I would have thought that if there was any grounds for not paying them back, it would be plastered all over the posts!!

Please be careful with Mackenzie Hall, read posts in Debt collectors these people can be right bullys if you let them.
I would be very surprised if they accepted you payment. I am not trying to hide from my debt, except quickquid were not helpful at all.

Thanks for the heads up. I cant see any reason why they wouldnt accept the proposal, it spreads the payment over 8 months which is not a long time, some people offer £10 per month and it would take years to pay back at that rate! They cant bully me as a) i dont answer phone calls and b) i simply dont have anymore money to give them, so the two options are accept my proposal or take me to court and let them decide what I have to pay, and given my previous experience would probably be nowhere near what I am offering over a considerably longer period of time!! You are right about quickquid though, totally unacceptable to any offer, no sort of negotiations, little/no response to any correspondence. Not too bright are they!!!
i would love to see one of these agreements to give them the once over
I'll see if I can get mine scanned up tomorrow
I don't think it's their agreements that are the problem usually, it's the way that they go about trying to get the debt. Plus their inconsistency in how they deal with people. At least with DCAs CC copmanies etc you can see other posts from people who are dealing with the same people and most of the time it's like a mirror image. With this lot it depends what side of the bed they get out of
I think their rules must be - there are no rules..................
