    Default PPI: Halifax & Sainsbury's

    I am looking at claiming back PPI I have paid in the past on credit cards from Halifax and Sainsbury's, but need to send SARicon(s) to find out information needed to see if I have a claim and how much I actually paid. As they are both part of HBOS can I send one SARicon for both acounts or do I send them separately and pay twice?

    I also paid PPI on a House of Fraser storecard which was originally under GE Money. This year that changed to Santandericon and then due to me having financial problems this has now been passed on to a DCAicon. Who do I send the SAR to?

    I would send SAR to whoever signed the Consumer Credit Agreements.
    So please check out the agreements to see the details on the creditor.

    Start again with the name on the Consumer Credit Agreement if it is GE money that is where to start. It is unlikely Santander will give you any satisfactory answer as they have just taken over, but in the end it may well be Santander paying out, (with a fight of course) such is the financial whirlpool. Not me Guv we have just acquired the company

    I believe this is one way the financial institutions try and reduce the regulatory risk they take on. Build up a massive industry, mis-sell PPI, sell on the industry to avoid the flak and multiple claims. 8-)

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

    I haven't got copies of the Consumer Credit Agreements. In the SARicon template it asks for 'full copies of all contracts' so would that be the CCA's, or have I got to request these separately?

    I noticed that both have the same address as Card Services at Pitreavie Business Park, Dunfermline which is why asked if I could do just one payment of £10, but I'll send individual SARicon's to each, at least they can't say my request has been lost between departments!

    Ok, typing out CCA requests to all creditors but need clarification regarding whether or not I send them to the original creditor or the DCAicon. A company called iQor Recovery Services Ltd have sent me letter stating that Next Directory have passed my debt to them with instructions to recover the outstanding balance in full. Does this mean the debt still belongs to Next and therefore I should send the CCA to them and not iQor?

    Send the SARicon to IQOR and they'll soon pass the debt back to the original creditor.

    It's more fun than sending the SARicon directly to Halifaxicon

    HALIFAX: 13/01/07 Sent S.A.R - (Subject Access Request) letter (marked as rec'd 16/01)
    Paid in full in March 07

    Thanks djgordyp but the DCAicon iQor are acting for Next and I don't think I need a SARicon for them, I'm sending a CCA request letter and just wanted to know if it was to be sent to them as they have been instructed by Next to collect.

    My Halifaxicon and Sainsbury's cards have so far not been passed on, one reason being Halifax helped themselves to my arrears from my bank account when I got paid!! By the way I have sent SARicon's to both.

    I've done SARicon's to Halifaxicon and Sainsbury's as I don't have statements from when I was paying PPIicon, but should I do prelim letters to ask for refund of charges as I know how much these are, they're only from May this year - I've previously reclaimed from Sainsbury's.
