    Default Help with Lloyds Charging for an account I dont use!

    Hi There

    Was wondering if you someone could help me!

    I filled out an application for a Gold current account with Lloydsicon back in March 2008, they then sent me everything to get started from the day I received everything, its been in my bottom draw unopened as I decided I didnt want to bank with them and chose to go to another bank. Hadnt heard from them since that time.

    In April this year Lloyds sent me a statement to saying owe £57.00, apparently the Gold Current account you have to pay for each month and since they didnt have any of my current bank details they had been deducting it from the overdrafticon so that is how they got to £57.00

    I called Lloyds as soon as I got the letter as I was confused since I handnt used the card and the card has not even been activated how they could charge me. The lady was a complete incompetent ass, she was saying well were charging you because you use the account. I asked her to look on her screen and to tell me what activity if any was on the account and she told me there wasnt any, so I then asked again so why are you charging me, you just told me because I use the account now looking on the system you can see I have NEVER used it she just kept saying because I used the account.

    I then asked her ok lets say I go along with what your saying how come th account has been opened since March 2008 and you have been charging me every month since it opened and it is now April 2009 and this is my first statement/correspondence from yoursleves. Now we all know that when it comes to a bank account being overdrawn they send you a letter straight away yet I have none. She couldnt answer. I told her I want the account closed/put on hold so I can do more invesigating she told me she cannot do that, I asked why she said because you owe us money for using it. Asked what am I supposed to do then, I dont want anymore charges and asked what is it saying on the system she said the account has been put on hold ! Im sure I had just asked her to do that and she told me No.

    I then told her that I dont live at the address the statment was sent to and hadnt done for 10 months and for them to put my new address down on the system she told me she couldnt do it as Im not set up for telephone banking and I need a password to discuss my account for security reasons ! Yet for the whole telephone conversation we were discussing my account.

    Anyways wanted to know what I should do, do I have to legally pay this money or can I complain to lloyds?

    First of all don't deal with these people on the telephone without recording your callsicon. Always record your callsicon.

    Secondly don't waste your time with these people. Simply write them a formal complaint about it and tell them that you wanted to go to the Ombudsmanicon.

    You're quite right that they should have corresponded with you about overdrafticon and also they should be be sending you statementsand it seems that they haven't done that so that even if they are right to charge you, they haven't conducted your account according to the contract and accordingly it seems to me that you are released from any contractual obligation. Anyway, as you say you haven't used it and it seems to me to be not fair and reasonable within the meaning of the Banking Codeicon to charge you.

    Write to them formally telling them that you require the account to be closed completely and that it is in dispute. Enclose a copy of your complaint letter.

    Under separate coversend the complaint letter. They will blah blah you and tell you that they will come back to 8 weeks. They may not do that . I have found that they are often incapable of sticking to their targets -- and often the complaint letters just never seem to be dealt with at all. They are useless. Push it through. If you don't hear after eight weeks then write them a seven-day warning that you will go directly to the ombudsmanand then do exactly that. Complain to the ombudsman that they are mis-conduct in the account, there is unfair within the banking code that they should charge you any way, and finally that they are failing to observe their targets the complaint and that they are attempting to frustrate your access to the ombudsman. File it all on.
