    Default ATM Dispute for non UK resident

    Hello everyone, I'm new here but really need some good advice. I've searched around the forums a bunch but have yet to see a situation similar to mine.

    It's complicated. I'm an American visiting the UK for a few months, and I recently spent the year teaching in France. I have an account with France's Banque Populaire and I have been withdrawing the money from that account in large chunks in order to empty it (closing a French account from overseas takes months, and they often lose your details, so I didn't want to risk that situation).

    A few days ago I tried to withdraw 250 pounds from this account at a Barclaysicon ATM. The transaction seemed to run as usual and it asked if I would like a receipt (to which I stupidly said no, will never do that again!), and then it spit out my card as if the transaction was complete. But no money came out. I tried twice more, thinking it was just a glitch, but both times it now gave me the message that my bank would not allow the withdrawal - which usually means I've hit my limit for the day. So this is when I got nervous.

    The debit to my account just appeared today. My questions are these - what rights do I have as an American to file a court claim in order to get my money back? Obviously I'll be ringing my French bank, but if an ATM dispute needs to be done in person then I'm out of luck. Not to mention French banks in general make English banks look like models of efficiency. I would like to try to get my money from Barclays, but I know they will tell me to take it up with my bank - which is ridiculous since it's their ATM that got me in this mess. Surely they can check and see that it was unbalanced for the day I was there, even view CCTV footage to check out my story, and just give me what I'm owed? Ahh... wishful thinking, I know.

    Anyway, I'm off to visit that branch but I wanted to see if anyone here has any advice for an American who was robbed by an English ATM from her French account. Oy.

    i would suspect it makes no diff.

    all you need to do is contact the bank where the ATM the failed to payout is situated & they should be able to see the payout did not happen and you will get it refunded.

    TBH: most times this happens, in a day or two the money automatically re-appears in your A/C.

    A similar thing happened to me, the transaction went through normally except no cash was forthcoming. It was a ATM fault and I went into the branch & it was sorted out no problem, although I did have to sign a paying-in slip to credit my a/c again.

    Make sure you do not post anything which identifies you. Although we can remove certain things from the site unless it's done in a timely manner everything you post will appear in Google cache & we do not have any control over that.
