I've sent the pre-lim & lba letters to Lloyds re my bank charges. (from the SAR they sent me).
I got their generic 'on hold' letter back, so am now looking to move to the next step.
I've completed the calculations spreadsheet with the charges/OD interest & dates. This gives me a figure a little over £4000.
However, when this calculates the 8% interest, it takes the amount over the £5000 threshold for the small claims court.
I've seen where you have to enter the Breakdown of amounts, and it states the 8% ongoing from date of claim, which (i'm assuming the banks will try & delay as long as they possibly can) will take it into the £6000 bracket.
Do i proceed, as the amount i'm reclaiming is in the £4000 bracket.
Sorry if this doesn't make much sense.. it doesn't take much to confuse me at the moment!

A loss of claims will go over the small claims threshold because of the delay . Don't be fazed by it.
Have you put down all the interest which they have charged you over the years? Have you claim will your charges back to 1995?
If you look at our new claims templates you can also include a claim for restitutionary damages. This means that the court would order the bank to disclose how much profit they have made on your money whilst they have had it and they would then order the bank to payable over to you.
Put your claim in now. Don't hang around. Don't worry about the amount you are claiming -- just simply realise how much of your hard earned money, your time, your stress, Lloyds bank have benefited from.

Yes, all my charges have been included, as well as the interest, they've kindly detailed on my statements.
The only thing i'm unsure of, was the final charge they took on 7th Dec 00. I was having lots of financial problems and they told me they'd be closing my account. My Dad went with me to the branch to pay in the outstanding amount, and they said "Oh, there's charges of £2613 accrued you have to pay that off today as well
Dad paid it for me, and it's detailed in the cashiers notes as 'charges £2613 paid in. interest of 4.00. customer gave 10 for interest, £6 change given'.
Do i just details 2613 as charges on that date? They haven't given me a Breakdown of what they were for!
Dad said to not worry about paying him back, as he just wanted me to be able to stand on my own two feet again.. and i'm now 10 years older & wiser, and am still re-paying him, but it'd be great if i could give him a lump sum
From which year are you claiming your charges from i see you have said the last charge was dec 00 ? if they have sent you your statements are the charges of £2613 not listed on those as charges as notified on these.How many years statements did they send you?

They are all relating to the year 2000 when I hit financial meltdown, following the pretty nasty split with my now Ex.
The statements they have sent, do not show the £2613 charges. They show this amount being paid in as a credit & the next line states account closed whilst the account was 2613 in credit.
The cashier at the time said the accruing charges need to be cleared & that's why my Dad paid this in for me.
The notes from the Cashiers terminal who dealt with it, are the only thing i have stating the £2613 was to cover charges accrued on the account, but not yet debited.
what was the date on your statements of your last charge? sorry for all the questions im just trying to work out why the charges are not on any of your statements.What are your charges before you have added the interest.
