    Default lloyds tsb help needed

    hi could anyone give me some advise. i have a lone with Lloydsicon tsb and i could not afford the monthly payments when lloyds contacted me the lady on the other end was very helpful and understanding and she agreed on a me paying £30 per month starting on the 1st october 2009.then the next last week i got a nasty letter from lloyds saying i have defaulted on me payments and i have to pay the full ballance i phoned them up and the guy said i can see you have an agreement set up just ignore the letter,then today i got a letter from lloyds solicitors scm, saying that if the full balance is not payed in 14 days legal proceedings may be be issued i phoned them up and told them that i had an arangement starting on the 1st of october and she said that i was misinformed and i should have not been told i could set up an arangement and that it is going to be passed on to a debt collection agency.
    any advise would be most greatful

    In common with an enormous number of people, you have made a mistake of trusting your bank. You should never ever deal on the telephone with these people without recording your callsicon. If you had any evidence of phone callsicon that you have made , you would have something to leverage against them. As it is these people will just deny everything.

    If you're going to continue telephoning people then get a call recorder of some kind.

    How long have you had the loan? If you had it before 2007 then you should request the CCA to see whether it exists and whether it is properly executed.

    Lloydsicon are thoroughly untrustworthy and nasty. Apart from anything else the Banking Codeicon of practice makes it quite clear they will treat you fairly and reasonably. They also have a duty to do with you sympathetically if there are problems. All banks make the publicity point of saying that they are there to be talk to and that if their customers have problems then they should talk to them. You have seen what this brings you. You have tried to talk to them and yet they prefer to use force against you.

    Do you have a current account with Lloyds? Do you have a credit card with Lloyds? Have there been charges on these? If so you should start claiming these back and of the start reducing the amount of money that they think they can claim from you.

    thanks Bankfodder. i sent them a cca some time ago and i posted it on this site and i seemed to be ok. i was just thinking if i just continue to pay the £30 paer month like i arranged with them they mayt be very little they could do. just wandering though .

    some of my mail went to the wrong address ive just got it back and with it is a letter from Lloydsicon tsb saying thank you discussing your repayments with us .i am pleased to let you know that starting from the 1st october 2009 as a concession to you we will accept a reduced payment of £30 each month.
    can ltsb take any action with me having this letter to prove i have been in contact with them and not ignoring them as they say i have.
