    Default Used Car Purchase!!

    Hi all would like a little help if poss.

    I bought a Used car from ebayicon and went to pick it up from the place which turned out to be a second hand car dealer who said "I am just holding it for a friend who is on holidayicon" and it was not as described but I accepted it and was going to put right the faults but before I could do this, last night 10/09/09 I had an accident on the way to work which was caused by diesel leaking from the diesel tank onto the back wheel.
    Now the dealer is saying it is not his responsibility as the car was not his.
    But he gave me a receipt for my money.
    Can anybody give me some pointers.

    What expert told you this was the cause of the accident as that sounds rather implausible.
    What type and year is the car?

    I had the car looked at by a mechanic and not only that I can see for myself all the diesel coming from the bottom of the tank there is also a fine mist of the stuff all over the back of the car.
    It is a peugeot 306 Meridian 2001.

    A few questions;

    What does it say on the receipt? Does it have the dealer's details on it? And, have you got a copy of the E-bay listing?

    Yes it has the dealers details on it, Yes I have a copy of the ebayicon listing, on the receipt it states the price paid my address dealers details.

    I forgot to ask in my previous post, what were the 'faults' on the car and were these mentioned in the listing?

    The main problem you have is proving the accident was caused by the leak. You would have to get somebody qualified to compile a report confirming this was the case.

    If that barrier can be got over, you will have a case providing you have evidence that the car was sold by a dealer rather than privately, and can provide evidence that the listing contained miss-leading information.

    As someone qualified in compliling reports into cause and effect I can say it is highly unlikely that the diesel leak caused the accident as Conniff says.

    Best thing is to park the car up, reject it as is from a used car dealer and inform trading standards and e bay.

    Hopefully you'll get your money back.

    Sounds like a right dog of a car just from the above!!!!
