This is my first post and I would like some advice on a CCA and wether its enforceable. I asked for a copy the original agreement which the bank sent at ligntening speed.
My question is this, although the agreement seems to have all necessary information regarding the loan (apr, repayment period , signature etc...) it does not contain any details with regard to the overdraft that they have now instituted as a result of me not having made any repayments due to lack of income and ill health.
I did not want a Bank account with them in the first place and CERTAINLY didnt want another overdarft ! However on the rear of the agreement it states in the T&C's that :
8. The customer authorises the Bank to debit the payments due including interest and (if there is any breach of this agreement) the charges on default to the customer's current Account with the Bank.
Any help on this matter would be greatly appreciated
PS. Sorry to have re-posted but i did not seem to be getting any replies and the pressure from the bank is building :cry:
