I am currently gathering information regarding my MBNA credit card, the account is in dispute although they did recently send me a 'version' of my CCA which is not properly executed and so possibly not enforceable.
I just noticed a tick box on the documents they sent me for Payment Protection Cover. The card was taken out in 2001. I've been self employed since 1997 so PPI would not cover me anyway. I take it I have been mis-sold this cover, right ?!
I can't even remember how I even signed up for this card, would the application form have asked me if I was self employed or did they ask the question on the phone ??? With these questions in mind, what should I do next ?
I want to send another letter to MBNA telling them that I still do not acknowledge the debt until such time as they produce a properly executed agreement, I was going to send them a Subject access request. Would the SAR answer the questions above do you think ??
Should I keep the enforceability argument and the PPI issue seperate or combine them in future correspondence ?? If I was mis-sold the PPI what does that entitle me to do ?

Thanks for the reply dx. Unfortunately I have no clue how much is owed in PPI and the calculation you provided me left me scratching my head .
I owe around £11K at the moment on the card. When you say "how much is owed by you in PPI" what exactly do you mean ? I always thought they just added, say 5p for every £1 you borrowed ... or something like that - so my understanding is/was that I have been paying for it perpetually since I first used the card.

Thanks dx. I sent them an SAR and specifically mentioned the fact that I want ALL PPI information as well.
When I get it back would it be a case of me having to total all the PPI payments I have made thus far and then hitting them with a complaint for mis-sold PPI or is there something else I need to do ?

I got my SAR back, I am self employed but they have me down as working for a company, the company I was contracting with at the time. I must've given them that info for them to have it, but as I say, its incorrect - I was not employed, I was self employed.
Is there much use in going ahead with a PPI claim ?? It would've been my responsibility to make sure they understood hat I was self employed I guess ...

As DX says please read the stickies at the top of this forum there are many links to may sites they may help you get your money back. Do not ever accept what you are being told by your bank, Creditor etc.
The links may help you to a few £££ in rebates or refunds for mis-selling PPI.

I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner. ------------------------------------------------
Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
