Well, came home from my holidays to a really lovely letter from a Mr Udy.
"Oft say £12 is "likely to be fair" (snigger!) so we will change the charges you have incurred.... take £300 as goodwill gesture blah blah.... our charges are in line with competetors..... blah blah blah to avoid further fees keep within the limit.... blah blah"
(usual stuff.... not phased at all of course!)

Thank you for your letter offering £300 on the 14th August 2006
I would like to answer your 2 points raised in your letter. Firstly you say that the OFT have said that £12 is a figure that is “likely to be fair”. In reality £12 is the mark at which the OFT feels they will be compelled to intervene, therefore the true cost is well below this figure. You also state that your charges are in line with other cards. This well might be the case, but it does not make the level of the charges fair, it just means that these other institutions are also charging unlawful charges. As it happens, M&S money charge £5 which is still too much, but does demonstrate that £12 is excessive.
I do not believe that it costs even close £12 to “write” a letter or go over a limit, and I do not believe that a judge will either.
I calculate that you have taken £644 plus £95 which you have charged me in interest for the sums which you have taken. Total £739. Of course I will accept your offer of £300 towards this full amount.
I require repayment in full of this money. I give you a further 14 days in which to do so. After that I will proceed to small claims court without further notice, and then you will also be liable for costs and interest at 8%.

Thax Crusher for the letter and reasurance. I have given Mr Udy another 14 days to respond - see letter in my thread - by which time I'll be able to afford the court fee and, newly encouraged, I will see it through to the end...

Oh Crusher i've got a letter today from Robert Udy, talking about my credit reference file etc and nothing to do with my SAR. Anyway i looked in templates library and have send non-compliance letter no. 1. Will wait and see what happens next. Although i've have already had letters from Katherine Blunt - Legal Dept, saying information being sent to me soon. So in your expert opinion what will happen next?

They seem to be rather slow to me... I put in my mcol on the 8th, still no reply whatsoever...
I put my MCOL in on the 5th Crusher and they finally acknowledged it on the 16th. Nothing since then other than a letter last week thanking me for writing to Debitas and telling them to keep there nose out of it (who then passed it to another DCA who also got a stiff letter). My reply is in my thread, but so far its been very quiet at Cap1. I am expecting them to take it all the way now but guess what Cap1? Please go for it, I would love to spend a day at court watching you squirm as you have to explain how your charges are reasonable and fair to a judge

On hubbies account with cap one we filed on 1st sept, deemed served 6th, and got a full offer on sat just gone, waiting for the dosh as we speak lol. By my calcs you guys should get settlements this week. Good luck!

BoooHooo mine is going to be the one they forget about again lmao. Actually I am betting they would like to forget it as I have tried to put them on the spot. I want the cash, default removed, and I want the money crediting into my account as a PAYMENT not as a simple credit, anything less and they can meet me in court.
