I had debt with Halifax, The debt was sold to Capquest in 2007. I requested CCA gave them the 12+2 days. They wrote back with the signed original agreement. HOWEVER they did not comply with my second request being the Default notice, as I requested a copy of this also!
Have they defaulted now, seeing as their 12+2 days has gone and they have still failed to produce a copy of the DN?
What shall I do? Should I write to them, if so what shall I say, is there a template please. Please be kind enough to reply asap as I have to reply quick.

You will be very lucky to get a copy of the DN. They try to say that they don't need to send it again just that it was sent. Just because they haven't sent the DN doesn't make them in default however, does the "agreement" they sent comply with the regulations?
does it have :
APR
Credit Limit
Repayment terms
If not, it could be unenforceable

No it does not! It's an Application form. They are so silly! I need to disput this by a disput letter right?

Shame about the scanner. As the arguments with you and Capquest begin, they will send all sorts of letters which, if you had a scanner, would help us help you.
