taking a company with an unenforceable CCA to court
Hi,
I am in the process of making up papers to take a shopping catalogue to court. The have advised that they do not have a signed CCA, although they were not willing to refund me administration charges and shopping insurance charges so I am taking them to court.
My question is, they have stopped charging interest on the account as it is unenforceable. Does this mean that I can reclaim back all interest charges also?
Make sure you do not post anything which identifies you. Although we can remove certain things from the site unless it's done in a timely manner everything you post will appear in Google cache & we do not have any control over that.
Re: taking a company with an unenforceable CCA to court
The charges themselves don't out weigh the debt but the interest over the time would. Should I just go with the charges on the account instead of claiming the interest also?
Thanks

You can reclaim the charges and interest levied on those charges at the same rate they were applied.
What do mean "shopping insurance charges" did you ask for this and was this "insurance" explained in full- was it optional or did you feel you were obliged to take it out?
