    Default Barclaycard and the ICO

    Just to advise everyone who is or planning to complain to the ICO that they are currently well behind on cases.

    I have a case with Barclaycard for non conforming to a SARicon, I want all the data not just 6 yearsicon so complaint was raised in April.

    I phoned up ICO hotline today to chase and was told that its been passed to the CAD team but there are four CAD teams and all of them are months behind on work, the team with my case has work dating from January in their work queue still I've been told it should be looked at in the next couple of months

    So you need to be a little patient if the complaint is not a simple one I'm afraid.

    Is the advised route to obtain all data from a SARicon to make a complaint to the ICO and wait patiently for several months or does sending a N1 to the courts for non compliance get the full data and does using the court option have any guarantee of compliance?

    I would think the court route would be quicker at the moment but it costs £150 for a non-financial claim I believe so I took the cheap route

    As you would be claiming for your expenses in preparing the claim [2-3 hours research etc @£9.25 or so] wouldn't that make it a financial claim and then only require a court cost of £30 to be applicable?

    That would be your costs and hence not part of the claim itself, just an addition after the case has been decided.
