Hello- I have been communicating with Barclaycard asking them to furnish me with a signed copy of CCA. They did not send me the signed copy of the CCA instead keep sending documents pursuant to section 78. Kindly refer to the attached details sent to me and advise whether this is enforceable and whether I should continue to pay them? When I originally wrote to them about 3 months ago they kept ignoring my letters, After I sent them a £1.00 postal order 3 weeks ago they keep sending me details of section 78 unsigned. Barclaycard also says that they are satisfied with the documents they have provided. I disputed the debt 2 months ago and still continued paying them. Should I stop paying them if the details they have furnished is not enforceable? Thanks

I believe Barclaycard is quite desperate and suspect they do not have many proper agreements as this letter is being sent to all and sundry who ask for their agreement.
I have had at least six copies of the same letter - it is madness. I think 42Man's suggestion of trying an alternative strategy is the way forward.
Hello Gum, I have had all the letters from BC and over the last six months I have been harrased by both BC and Mercers by phone and text. I have sent them all the letters off this site, CCA 78, CPR 31.16, OFT complaints, fos complaints and even court papers to which I have a hearing on the 8th Sept 2009. I have had Solicitors letters from them, and also threatening door step visits but I will not give in. I stopped paying BC because I believe that they do not even hold an agreement so I will not pay for an agreement that does not excist. Don't give up Gum keep at them because it's about time these robbing Banks learned that we the public who by the way bailed them out are not taking anymore sh-- from their eligal activities.

I go the same letters and when ever you reply, BC never acknowledges, It is only some debt collection company who will call and say, I am sorry we are acting for BC. I do not believe they know much about the law. This forum is excellent. I am now preparing to take BC on. Charlick is it you who is taking BC to court. It will be interesting to see what happens on the 8th Sept. Wish you all the best Charlick for the 8th Sept and I will think of you and send you best wishes. Please come back and update.
I believe there's one or two others who are taking, or about to take the same steps to get a copy of the original agreement.
Also bear in mind that they say they don't need to supply a copy that is signed. Whilst that is partially true in court you can ask to see the actual original copy for inspection.
I would think carefully about withholding payment to them though - it could make a difficult situation worse even if you are in dispute with them. My own feeling is keep on paying if you can afford to.
