Default Pizemirth -v- BC (Morgan Stanley)

barclaycard sent me back a proforma relating to Morgan Stanley bank (whom they took over) with no signatures and talking about 2 different types of card, ie, standard and platinum, with 2 different apr,s. I say that is unenforcible, cos the actual interesticon rate of my card is unspecified and the rate of the lower one is more than 0.1% less than the higher one. Has anyone thought of that before?

Hi Pizemirth and welcome to CAGicon,

I've moved you posts into your own thread to avoid hijacking another.

They've send you their usual response to a CCA request - T&C's and a statement of account.

Your response should be to put the account in dispute because of their failure to supply your credit agreement as requested. Here's a letter you could adapt and use - http://www.consumeractiongroup.co.uk...ml#post1821561

Read through other threads here in the BC forums to see what is going on with many similar cases.

If there are penalty charges on this a/c, you should set about reclaiming them.

Read the Reclaiming Guide at Link No1 in my signatureicon below.

Also, is there any PPIicon on the account which could have been inappropriate or mis-sold. Read more about this in the PPI forums.
