firstly I must admit this is a very impressive site with lots of friendly advice and more regulars than i can shake a stick at
However my gripe has been, where is all this hard work going?
I am your average joe who managed to rack up several thousand pounds on a credit card I believe was issued by Goldfish back in 2002/3. I seem to remember applying for the thing online and do not actually remember signing anything (i know all my unsecured loans in the past have been signed and sent back).
I remember Morgan stanley buying out Goldfish or visa versa and carrying on as normal racking up more and more on the card. This continued with several credit increases whilst paying minumum payments to keep them happy. Then came barclaycard who im sure hiked up the interest rates and just seem happy to charge the world for their card.
A friend of mine who told me with great delight that he's wiped 8k of a credit card for the old "unenforcable credit agreement". He's then passed me a number of an essex based firm who will do all the checks etc... for about £95! (unfortunately i didnt ask who the credit card was with!)
to good to be true is written all over my face as i write this as well as probably a few dozen other stealth readers of this site.
What im getting at in all this rambling is what does going to war with BC get you?
I can understand people who are on the poverty line sorting out PPI and fee's etc.. but it not like I could go and get 7k wiped off my card with a single letter to them surely!
I cant see how busting a ball over this all will do much more than put you in an early grave!
I spent several hours studying this site tonight and the crooks of it seem to be that if i send off a SAR it will probably show my credit agreement is unenforcable, but is worth diddly unless i get it enforced at court.
have i gone completely off at the deep end on this or is taking on BC really worth all of this?

Your debt is reduced by the amount of the unlawful charges debited, mis-sold PPI and all interest levied thereon. If you still owe them anything after that, you can stop paying them.
And no, its not going to happen with a single letter.
Several letters, a small claim and possibly a day in court would be more accurate.

I am a bit confused about this. I can see unlawful charges and missold PPI being reclaimable, but if the agreement is found to unenforceable in court, the debt is still there and cannot be ordered to be repaid to the card company so what is the basis for reclaiming interest?
a sort of fire-fighting role here. Hate HFC & their past compulsory PPI ethos

you cant reclaim interest! you can howevr reclaim interest that is assoc with a chagres reclaim or PPI reclaim, but there is no way to reclaim 'all' interest.
an unenforcable cca is just that, its unenforcable in a court of law, it does not mean the debt is 'wiped out' [he's mate is lying. or has been told a lie by the reclaim co.]
an unenforcable cca is not some magic bullet that wipes debt out, it just means that until an enforcable one appears, paymnets can be stopped.
it does howevr mean you are in a favourable position to make a very low F&F to close the matter.
don't be fooled !
