Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I bought a car from a dealer who used a receipt book of a now dissolved company that he used to run but failed to file on time and companies house struck his company off. I did not think anything about this at the time. We did not set up a formal contract.
I have a claim and he claims that I bought the car from this non existing company which got dissolved 2 years ago. The company has never existed at his current address and I am basically told to shove off.
Is it legal to use documents of a non existing / dissolved company for current business?
Without doubt NO. Does the receipt show the date? If it does then go straight to Trading Standards and the Police and also drop a note to Companies house providing the receipt is past the strike off date. If it is post stike off then it is I would alledge fraud. If not then it's a trading standards issue.
